OFFICIAL RULES
NO PAYMENT, ENTRY FEE OR PURCHASE REQUIRED. OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES, THE DISTRICT OF COLUMBIA, AND CANADA, EXCLUDING QUEBEC. VOID WHERE PROHIBITED.
1. CONTEST DESCRIPTION AND SPONSOR
: World Wrestling Entertainment, Inc., 1241
East Main Street, Stamford, CT 06902 ("WWE"), invites
its fans to participate in the WWE Oops! Contest ("Contest")
and submit a brief statement of approximately seventy-five
(75) words explaining how to improve WWE's website located
at www.wwe.com.
The Contest is sponsored by WWE. THIS IS NOT A SWEEPSTAKES.
NO PURCHASE NECESSARY. A purchase will not increase
a contestant's chances of winning.
These Official Rules govern all submissions and constitute
an agreement between each contestant and WWE relating
to the contestant’s participation in the Contest.
By entering the Contest, contestants (and the parents
or guardians of contestants who are minors in their
state or province of residence) agree to abide by these
Official Rules. WWE reserves the right permanently to
disqualify from this Contest any person it believes
has violated these Official Rules.
NO MONETARY COMPENSATION, PAYMENTS, RESIDUALS,
REUSE FEES OR OTHER REMUNERATION WILL BE MADE TO CONTESTANTS
FOR THEIR SUBMISSIONS OR FOR WWE’S USE OR IMPLEMENTATION
OF ANY ASPECT OF THEIR SUBMISSION.
2.
ELIGIBILITY: Contest open only to legal residents of the 50 United States, the District of Columbia, and Canada, excluding residents of the province of Quebec, who are at least fourteen (14) years old at the time of entry and have Internet access as of the start of the Contest on November 1, 2003. Employees of WWE, its parent, subsidiaries, affiliates, promotion and advertising agencies, and anyone involved in the Contest's development or execution, the immediate families of any such employees (meaning spouse, parents, siblings, children and their spouses), and members of the households of such employees, are not eligible. Minors in their state or province of residence must have the prior consent of a parent or legal guardian to participate.
3. FORMAT AND CONTENT OF SUBMISSION:
Each contestant must submit on an 8½ x 11 sheet
of paper a brief statement of approximately seventy-five
(75) words explaining how to improve WWE's website www.wwe.com
along with the following information: (i) name; (ii)
address; (iii) date of birth; (iv) age; (v) daytime
and evening telephone numbers; (vi) e-mail address (optional);
and (vii) gender (the "Submission"). Submissions may
be typed or legibly handwritten. No one other than the
contestant may contribute to the creation or content
of the Submission. Submissions must not include unlawful,
threatening, libelous, defamatory, obscene, vulgar,
pornographic or profane material, material that violates
the intellectual property or moral rights of others,
or material that otherwise violates these Official Rules
in whole or in part.
In making a Submission, each contestant
represents and warrants that his/her Submission is original,
that the Submission and the ideas contained in the Submission
are the contestant’s, that the contestant owns
the right to all materials and ideas in the Submission,
that no one else has any rights to the Submission, and
that WWE’s use of the Submission, or any part
thereof, will not infringe upon the rights of any third
party, including, without limitation, any moral rights
or intellectual property rights. Submissions must be
made on an individual basis and no one other than the
contestant making the Submission will be credited for
making the Submission.
In explaining how to improve www.wwe.com,
contestants are encouraged to be creative, original
and have fun. Contestants may focus their Submission
on one or more aspects of www.wwe.com or on the website
as a whole. Contestants might want to consider the following:
(i) what is missing from the website; (ii) what items
might be removed from the website and why; (iii) how
to make the website more fun and entertaining; (iv)
how to make the website more user friendly; (v) how
to improve a particular WWE Superstar’s biography;
and (vii) identifying an error(s) on the website with
an explanation as to why correcting the error(s) is
important.
WWE reserves the right to disqualify
any Submission that fails to meet the requirements of
these Official Rules.
4. HOW TO ENTER:
Submissions must be prepared in accordance with the
requirements of Paragraph 3 of these Official Rules.
Each contestant also must complete and sign a Statement
of Eligibility, Consent and Liability Release, and where
not prohibited by law, a Publicity Release ("Consent
and Release Form") that (i) confirms eligibility and
compliance with these Official Rules; (ii) grants to
WWE, its subsidiaries, agents and affiliates all rights
in the Submission; (iii) grants to WWE, its subsidiaries,
agents and affiliates the unrestricted, irrevocable
right, but not the obligation, to use contestant's name,
address, photograph, picture, likeness, moving image,
voice, biographical material, personal information,
and the ideas contained in the Submission for improving
www.wwe.com,
whether in their original form, or as altered, edited,
lifted or reproduced by WWE, its subsidiaries, affiliates
and agents, for any and all lawful purposes, in any
and all media; and (iv) represents that the contestant
has the power to make the releases, waivers and assignments
and grants of rights that he/she is making. Parents/legal
guardians of contestants who are minors in their state
or province of residence also must sign the Consent
and Release Form. In all cases, WWE reserves the right
to request proof of age, parenthood or guardianship,
and a contestant will be disqualified if WWE, in its
sole discretion, finds that the proof is unsatisfactory.
Contestants should visit www.wwe.com,
where the required Consent and Release Form can be printed.
A Consent and Release Form also can be obtained by mailing
a request, along with a self-addressed, stamped envelope
to: Request Consent and Release Form, WWE Oops! Contest,
1241 Main Street, Stamford, CT 06902.
Contestants must mail an original, signed and complete Consent and Release Form along with their Submission in a first class stamped envelope to: Submission, WWE Oops! Contest, 1241 Main Street, Stamford, CT 06902. Only one Submission and Consent and Release Form per envelope. Entries must be postmarked no earlier than November 1, 2003, when the Contest begins, and received by WWE no later than 11:59 p.m. (EST) on January 15, 2004, when the Contest ends. A contestant who fails to submit an original, signed and complete Consent and Release Form along with each Submission or who fails to provide any other information or materials requested by WWE, or who otherwise provides information and documentation that WWE in its sole discretion determines to be incomplete, erroneous or misleading, may, in WWE's sole discretion, be disqualified from the Contest.
5. SELECTION OF WINNERS:
From January 16, 2004 through January 30, 2004, a panel
of judges consisting of WWE employees (the "WWE judges")
will meet at WWE's offices at 1241 East Main Street,
Stamford CT 06902 and, in their sole discretion, select
the five (5) best Submissions from among all eligible
Submissions received according to the following criteria:
(i) whether or not the Submission is creative, innovative
and original; (ii) whether or not the Submission adequately
explains how www.wwe.com
can be improved; (iii) whether or not the proposal for
improving www.wwe.com
set forth in the Submission would improve the website
if implemented: and (iv) whether or not the Submission
identifies weaknesses, errors or problems with www.wwe.com.
Each of the criteria will be given equal weight. To
the extent Submissions set forth what WWE judges, in
their sole discretion, determine to be essentially the
same proposal for improving www.wwe.com,
the Submission that best meets criteria 2 (set forth
in this Paragraph immediately above) as determined by
WWE judges in their sole discretion will be eligible
for a prize and the other Submissions will be disqualified.
WWE shall attempt to personally contact
the selected contestants by telephone five (5) times
over a period of two days beginning on February 2, 2004.
If a selected contestant cannot be personally contacted
during this period, then the contestant who the WWE
judges determine submitted the next best Submission
according to the criteria set forth in this Paragraph
5 shall be selected an alternate and WWE shall then
attempt to telephone that alternate contestant in accordance
with these Official Rules.
When a selected contestant is personally
contacted by WWE, WWE will ask them to correctly answer
a mathematical skill-testing question without assistance
of any kind, whether mechanical or otherwise. If the
selected contestant fails to correctly answer the mathematical
skill-testing question, the contestant who the WWE judges
determine submitted the next best Submission according
to the criteria set forth in this Paragraph 5 shall
be selected an alternate and a winner confirmed in accordance
with these Official Rules.
The decisions of the WWE judges are
final and binding with respect to all aspects of this
Contest.
6. FIVE (5) PRIZES: Odds
of winning depend upon the number of eligible entries
received.
7. WWE'S OWNERSHIP RIGHTS: Submissions and any other related documentation and materials will be retained by WWE and will not be returned. By making a Submission, each contestant (and the parent or legal guardian of each contestant who is a minor in their state or province of residence) waives his/her moral rights in the submission and assigns all other rights, title and interest in and to the Submission, including, any copyrights, to WWE and acknowledges and agrees that WWE owns the Submission and all the ideas contained in the Submission. Each contestant (and the parent or legal guardian of each contestant who is a minor in their state or province of residence) also acknowledges and agrees that WWE shall have the exclusive, unrestricted, perpetual, royalty-free, worldwide, freely-assignable and irrevocable right to use, implement, edit, alter, copy, reproduce, license, sell, rent, disclose, display, publish, prepare derivative works from, perform, distribute, exhibit, broadcast, or otherwise exploit the contents of the Submission, in whole or in part, in any form, media or technology, now known or hereafter developed, including, without limitation, print media, broadcast television, radio and the Internet, for any purpose whatsoever, including, but not limited to, advertising, promotion, entertainment and commercial purposes, without any payment to, or further authorization by, the contestant. Although WWE has such exclusive rights of ownership, WWE is not obligated to exercise these rights. Contestant's Submission further signifies contestant's agreement (and the agreement of the parent or legal guardian of each contestant who is a minor in their state or province of residence) that (i) contestant may not use or permit others to use the Submission without obtaining the prior written approval of WWE; and (ii) contestant (and the parent or legal guardian of each contestant who is a minor in their state or province of residence) will execute such further documents and instruments and take any further acts as WWE may reasonably request in order to effectuate these terms.
Each contestant (and the parent or legal guardian of each
contestant who is a minor in their state or province
of residence) further agrees that WWE has the unrestricted,
irrevocable right, but not the obligation, to use contestant's
name, address, photograph, likeness, moving image, voice,
biographical material, and personal information in perpetuity
throughout the world, whether in connection with the
Contest or not, in any and all media (including print
media, broadcast television, radio and the Internet)
now existing or hereafter discovered or developed, for
any and all purposes including, without limitation,
advertising, promotion, entertainment and commercial
purposes, without additional consideration to, or further
authorization by, the contestant.
In making a Submission and agreeing to participate in the Contest, each contestant (and the parent or legal guardian of each contestant who is a minor in their state or province of residence) represents and warrants that she has the right to grant to WWE all the rights granted in this Paragraph 7 and the Consent and Release Form.
8.
LIMITATION OF LIABILITY: By submitting a Submission to WWE and agreeing to participate in the Contest, each contestant (and the parent or legal guardian of each contestant who is a minor in their state or province of residence) agrees (i) to release WWE, its parent companies, subsidiaries, and affiliates, and each of their respective owners, shareholders, agents, officers, directors, employees, representatives, successors and assigns and all others associated with the Contest (collectively, with WWE, "the Releasees"), from any and all liability arising in any way from the Contest, the receipt, use or misuse of a prize or parts thereof, contestant's production and submission of a Submission and the Releasees' review and use of the Submission, or any parts thereof, including, without limitation, liability for any costs, fees, expenses, injuries, losses, harm, damage of any kind whatsoever, death, personal injury, property damage, liability to any other persons, including, without limitation, liability arising from any claim relating to the breach or alleged breach of the representations and warranties each contestant is making in connection with her Submission, and liability by virtue of any blurring, distortion, or alteration that may occur in connection with the exercise of WWE's rights, whether intentional or otherwise; (ii) to indemnify the Releasees from any and all liability arising in any way from third party claims relating to the representations and warranties contestant is making in connection with his/her Submission; and (iii) that the Releasees are not liable for any similarities between contestant's Submission and future WWE websites, products, publications or programs.
9. DISPUTES/GOVERNING LAW: By making a Submission, each contestant (and the parent or legal guardian of each contestant who is a minor in their state or province of residence) agrees that these Official Rules, the terms of the Consent and Release Form, and any and all claims arising in connection with the Contest shall be governed by the laws of the state of Connecticut, without giving effect to any choice of law or conflicts of law principles. It is further agreed that any action at law or in equity arising out of or relating to these Official Rules, the terms of the Consent and Release Form, and the Contest may be filed only in the federal and state courts located in Fairfield County, Connecticut, and by making a Submission, each contestant consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. If any of these Official Rules, or the terms of the Consent and Release Form, are held to be unlawful, invalid or unenforceable, the remainder of both these Official Rules and the Consent and Release Form will remain in full force and effect.
10.
GENERAL TERMS AND CONDITIONS: Contest subject to all Federal, provincial and local laws and regulations. CONTEST VOID IN QUEBEC AND ELSEWHERE WHERE PROHIBITED. WWE reserves the right, in its sole discretion, to withdraw or amend this Contest in any way, at any time, and without notice if any matter interferes with its conduct as contemplated by these Official Rules. Contest materials are void if they contain printing, mechanical or other errors. Incomplete entries will be disqualified. No responsibility will be assumed for lost, late, stolen, illegible, incomplete, damaged, postage due, misdirected, misplaced or mutilated entries. WWE and their respective agencies, affiliates and representatives are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software transmissions or technical failures, incomplete, delayed or garbled transmissions or other errors or problems of any kind, whether mechanical, electronic, human or otherwise. WWE reserves the right, in its sole discretion, to cancel or suspend this Contest should a virus, bug, computer or other problem beyond WWE's control corrupt the administration, security or proper play of this Contest. WWE reserves the right to award prizes from among the entries received prior to the date of suspension. If WWE determines that there is any suspected or actual tampering with the Contest, or if technical difficulties compromise the integrity of the Contest, WWE reserves the right, in its sole discretion, to void any entries that appear to have been submitted fraudulently or to cancel or modify the Contest, in whole or in part. All Submissions become the property of WWE and none will be acknowledged or returned.
11. DATA COLLECTION:
WWE collects personal information from you when you
enter the Contest. This information only will be used
in connection with the Contest. Your personal information
may be used to send you additional information about
WWE, its products and programming only if you provide
your affirmative consent to receive such information.
Your personal information will not be used for any other
purpose and will not be shared with anyone else. See
WWE's privacy policy at www.wwe.com.
