WORLD WRESTLING ENTERTAINMENT, INC. "Hellboy" DVD WWE Sweepstakes OFFICIAL SWEEPSTAKES RULES NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE ODDS OF WINNING. 1. HOW TO ENTER: Enter online at http://sponsors.wwe.com/hellboydvd/index.html by filling out the online entry form and clicking "Register." Online entries must be received between 12:01 a.m. (ET) on July 20, 2004, when sweepstakes begins, and 11:59 p.m. (ET) on September 3, 2004 when sweepstakes ends. Only one entry per person, per unique email address. In the event of a dispute as to the identity of an entrant, any on-line entry will be deemed submitted by the authorized account holder of the e-mail account from which it was sent. The authorized account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible. 2. ELIGIBILITY: Sweepstakes open only to legal residents of the 48 contiguous United States and the District of Columbia (this excludes Alaska and Hawaii), who are (13) years of age or older at the time of entry, except employees (and their immediate families -- meaning spouses, parents, siblings, children and their spouses) of World Wrestling Entertainment, Inc. ("WWE"), Columbia TriStar Home Entertainment, Inc., Revolution Studios Distribution Company LLC, Hilltop New Media, Inc. ("Hilltop"), Hilton Hotel Corporation, Orbitz, LLC and their respective affiliates, promotion and advertising agencies and anyone involved in the Sweepstakes' development or execution ("Sweepstakes Entities"). Online entrants must have Internet access as of July 20, 2004. 3. SELECTION OF WINNERS: One (1) potential Grand Prize winner and five (5) potential First Prize winners shall be selected at random from all eligible entries, on or about September 16, 2004 and notified by e-mail by WWE whose decision is final and binding on all aspects of this Sweepstakes. If a potential winner cannot be reached within five (5) days, or in the event of non-compliance with any of the requirements of these Official Rules, or should potential winner be unavailable or unwilling to accept the prize, that prize will be forfeited, and an alternate winner will be selected at random from the remaining eligible entries. Sweepstakes Entities shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules, such potential winner will be disqualified and an alternate winner will be selected at random from the remaining eligible entries. 4. PRIZE: One (1) Grand Prize consisting of a trip for two (2) to Prague, Czech Republic with a five (5) night hotel stay at the Hilton Prague Hotel. Grand Prize package includes (i) economy round-trip air travel (via air carrier selected by Orbitz.) for two (2) from major gateway city airport near the Grand Prize winner's residence to Prague and (ii) five (5) nights hotel accommodations (one (1) deluxe, double occupancy) at the Hilton Prague Hotel including breakfast each morning (room rate and tax only). Grand Prize trip is subject to air travel and hotel availability, holiday and blackout dates, and other restrictions. Twenty-One day advance booking and Saturday night stay required. Travel must be completed by December 31, 2004. If travel is not completed by December 31, 2004, the Grand Prize will be deemed forfeited. Grand Prize winner and his/her guest must take air travel on same itinerary. Lost or stolen tickets, travel vouchers or certificates will not be replaced. Once booked, no change, extension, or substitution of trip dates is permitted, except by Hilltop at its sole discretion. If Grand Prize winner is from a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be the allotted guest. If guest is from a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless he or she is the Grand Prize winner. Grand Prize winner and guest are responsible for obtaining all necessary and required travel documents. Hilltop shall be responsible for fulfillment of the Grand Prize and shall make all travel arrangements. All expenses not specified in these Official Rules, including, without limitation, taxes, insurance, meals, gratuities, additional spending money, incidental expenses, phone calls, mini-bar services, transportation, fees or charges resulting from travel delays, modifications and cancellations and other costs and expenses relating to the use or acceptance of the Grand Prize are the sole responsibility of Grand Prize winner and his or her guest. Grand Prize is non-transferable. Five (5) First Prizes, consisting of: one (1) Hellboy branded messenger bag (ARV: $20), one (1) Hellboy hat (ARV: $10) and one (1) Hellboy t-shirt (ARV $10). 5. APPROXIMATE RETAIL VALUE APPROXIMATE RETAIL VALUE (ARV) OF GRAND PRIZE: $4,700 (Actual value will depend on Grand Prize Winner's point of departure and airfare fluctuations). The total ARV of each First Prize is $40.00. The total ARV of all prizes awarded is $4,900. 6. ODDS OF WINNING: Odds of winning depend upon the number of eligible entries received. REQUIREMENTS OF GRAND PRIZE WINNER AND GUEST: Potential Grand Prize winner (his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor), will be required to sign, execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, (where legal) a Publicity Release, and any other documentation that Sponsor or Hilltop may require (collectively "Affidavit/Release"), within five (5) days after receipt or potential Grand Prize winner may be disqualified and alternate potential winner may be selected. By returning the completed Affidavit/Release, winner attests to the authenticity of his/her winning entry. Guest (guest's parent/legal guardian, if he/she is a resident of a jurisdiction that deems him/her to be a minor) will be required to sign, execute, have notarized and return a Liability Release, a Publicity Release, and any other documentation that Sponsor or Hilltop may require within five (5) days of receipt of these documents by potential Grand Prize winner. 8. CONDITIONS OF PARTICIPATION: Prizes may not be substituted, transferred or redeemed for cash, except by Hilltop, who reserves the right to substitute similar prizes of comparable or greater value in its sole discretion. By taking part in this Sweepstakes, participants agree to be bound by these Official Rules. Sponsor and Hilltop reserve the right permanently to disqualify from this Sweepstakes any person they believe has intentionally violated these Rules. Entry constitutes permission (except where prohibited by law) to use a winner's name and hometown on Sponsor's websites and to use a winner's name, city, state, likeness and/or voice for purposes of advertising, promotion and publicity without additional compensation. 9. GENERAL TERMS AND CONDITIONS: Sweepstakes subject to all Federal, state and local laws. SWEEPSTAKES VOID WHERE PROHIBITED. All Federal, state and local taxes are sole responsibility of winners. Sweepstakes materials are void if they contain printing, mechanical or other errors. Incomplete entries will be disqualified. No mechanically reproduced entries allowed. No responsibility will be assumed for lost, late, stolen, illegible, incomplete, damaged, postage due, misdirected or mutilated entries. "Releasees" (as defined below) are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software transmissions or technical failures, incomplete, delayed or garbled transmissions or other errors or problems of any kind, whether mechanical, electronic, human or otherwise. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should a virus, bug, computer or other problem corrupt the administration, security or proper play of this Sweepstakes. Sponsor and Hilltop reserve the right to award prizes from among the eligible, non-suspect entries received prior to the action requiring modification. If Sponsor determines that there is any suspected or actual electronic tampering with the Sweepstakes, of if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to void any entries that appear to have been submitted fraudulently or to cancel or modify the Sweepstakes, in whole or in part. All entries become property of Sponsor and none will be acknowledged or returned. 10. LIMITATION OF LIABILITY: By participating in this Sweepstakes, all entrants release Sponsor, Sweepstakes Entities, and their respective affiliates, subsidiaries, parent companies, prize suppliers, advertising and promotion agencies, and all of their respective officers, directors, employees, shareholders, representatives, agents and all others associated with the development or execution of this Sweepstakes (collectively, "Releasees") from any and all liability in any way arising from this Sweepstakes and/or the receipt, use or misuse of a prize or parts thereof (including activity or travel related thereto), including, without limitation, liability for death, personal injury, damage or loss of any kind, and from liability to any other persons relating to or resulting from entering or downloading materials or software in connection with this Sweepstakes. 11. DISPUTES/GOVERNING LAW: In the event of any dispute regarding the identity of a person submitting an entry, the entry will be deemed submitted by the authorized e-mail account holder, which is defined for these Rules as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participants agree that this Sweepstakes is governed solely by United States law. Any claims arising out of the Sweepstakes shall be governed solely by United States law and may be brought only in a Federal or state court in Connecticut. If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. 12. Winners' names and contact information will be shared by WWE with Hilltop so that Hilltop may contact winners for the purpose of fulfillment of the prizes. Additionally, if an entrant chooses to opt-in to a specific offer from a participating Sweepstakes Entity, his/her personal information will be subject to that Sweepstakes Entity's privacy policy and terms of service (if applicable) and such entrant agrees to receive additional email communication from that Sweepstakes Entity.
